Sixth State Considers Rendering NDAA as Unconstitutional

Virgina passed a bill 96-4 which prevents anyone including Virginians in the military from assisting the US armed forces in the investigation, prosecution, or detention of a US citizen as a violation of the Constitution.  Many liberal and conservatives have expressed their dissatisfaction with President Obama as he signed the bill on New Years Eve and did not remove the indefinite detention language as promised.

Arizona is one senate vote away from as they put in their bill,  prohibiting any state agency in implementing Sections 1021 and 1022 of the National Defense Authorization Act of 2012 and those in violation of the Arizona law will face a misdemeanor.

Maryland, Oklahoma, Tennessee and Washington are also reviewing their options for a remedy to the indefinite detention aspect of the NDAA.

Local governments are also trying to nullify the NDAA.  Six local towns including Macomb, NY and Fairfax, CA and New Shoreham, RI passed resolutions in protest of NDAA detention.

Tenth Amendment Center director of communications, Mike Maharrey said, “Most Americans recognize that the federal government rarely, if ever, relinquishes power once it grasps it. So state and local governments are taking James Madison’s words to heart and interposing on behalf of their citizens.”
